How Fast Do Electric Bikes Go? Check More Than MPH
California electric bicycles may assist up to 20 mph in Class 1 or Class 2 and 28 mph in pedal-assisted Class 3; wheel speed can be higher when the rider pedals without help or coasts downhill. Under California Vehicle Code section 312.5, the bicycle must have fully operable pedals and a motor that does not exceed 750 watts, and its permanent label must state the class, top assisted speed, and motor wattage in at least 9-point Arial. Class 1 and Class 3 walk or start assistance is capped at 3.7 mph. A 40-, 50-, or 70-mph throttle claim describes a vehicle outside California's e-bike classes, even if it has pedals. Where that vehicle may travel is a separate question governed by state and local access rules.
The assisted-speed figure is a shutdown instruction for the motor. It does not promise how fast the wheels can turn or how soon the bicycle can stop.
What does California require on an e-bike's permanent label?
Vehicle Code section 312.5(c) has required, since January 1, 2017, a label permanently affixed in a prominent location. It must state the classification number, top assisted speed, and motor wattage in Arial font of at least 9-point type. Those are three separate entries. A speed badge on the display or a wattage claim buried in a product page does not satisfy the permanent-label instruction.
Treat the label like a furnace rating plate. The class identifies the assistance rule. Top assisted speed records the point at which the motor must stop helping. Motor wattage is the figure to compare with California's 750-watt ceiling.
California does not prescribe one wattage to print on every e-bike. The label reports the motor wattage of that bicycle, and section 312.5(a) requires the motor to stay at or below 750 watts. A buyer comparing a sticker with an advertisement should pause if one says “750 W” while the other promotes a higher “peak” figure. The statute uses motor power; it does not explain away a second number as marketing shorthand.
Federal and California texts disagree at the boundary. Title 15, United States Code, section 2085, and the Consumer Product Safety Commission definition in 16 CFR 1512.2 say “less than 750 watts (1 h.p.).” California section 312.5 says the motor “does not exceed 750 watts.” The federal provision classifies a consumer product; California's Vehicle Code classifies road use. Neither figure, standing alone, grants access to a local trail.
Does the advertised top speed require pedaling?
A listing's largest number may describe pedal assistance, throttle propulsion, an unlocked “off-road” mode, or downhill coasting. Only the first two describe what the motor does in ordinary operation, and California regulates them differently.
Class 2 is California's throttle class: section 312.5(a)(2) allows its motor to propel the bicycle without pedaling, then ends assistance at 20 mph. Class 1 and Class 3 require pedaling while the motor assists. A California Class 3 may support the rider to 28 mph, yet calling it throttle-capable at 28 mph misstates the current statute.
The narrow exception is section 312.5(a)(4). A Class 1 or Class 3 may propel itself for start assistance or walk mode, capped at 3.7 mph. A control that carries the bicycle to 20, 28, or 40 mph without pedaling is not that exception.
The federal product definition lines up with throttle, not with Class 3 pedal-assist. Section 2085 and 16 CFR 1512.2 measure maximum speed on a paved level surface when the bicycle is powered solely by the motor, with a 170-pound operator, and require that figure to be less than 20 miles per hour. The Commission’s March 15, 2024, advance notice of proposed rulemaking states that this definition “does not specify a limit on the speed for a low-speed e-bike when it is pedal-assisted.”
A rider may pedal beyond the cutoff, and gravity may take the bicycle faster downhill. Those speeds do not change the labeled top assisted speed because the motor has stopped helping. A traditional bicycle has no motor cutoff at all, which is why “how much faster is an e-bike really?” cannot be answered from class alone.
How fast can each California e-bike class assist?
PeopleForBikes, the U.S. bicycle-industry trade association, says it created the three-class model law. California Vehicle Code section 312.5 supplies the controlling figures for California: 20 mph for Class 1 and Class 2, and 28 mph for Class 3.

Class 3 is the highest assisted-speed class in that statute. Section 24016(b) exempts a qualifying electric bicycle from the Vehicle Code provisions on financial responsibility, driver's licenses, registration, and license plates. Those benefits follow the definition, not the seller's choice to call a product an “e-bike.”
When a 40, 50, or 70 mph claim leaves the e-bike definition
The common answer—anything electric with two wheels and pedals is an e-bike—is wrong. Fully operable pedals are one condition in section 312.5(a); speed, power, and assistance mode remain part of the definition.
Section 312.5(d), added by Senate Bill 1271 (Stats. 2024, Ch. 791), states that a vehicle is not an electric bicycle, and shall not be advertised, sold, or labeled as one, if the manufacturer intends it to be modifiable above 20 miles per hour on motor power alone or above 750 watts, if it has already been modified past those lines, or if its operable pedals have been removed. Those are the modification thresholds. Section 24016(d) forbids changing speed capability unless the bicycle still meets section 312.5(a) and the classification label is replaced. Section 24016(e), amended by Assembly Bill 545 effective January 1, 2026, forbids selling a device or application that can push a bicycle out of that definition.
PeopleForBikes put the pedal error plainly in a September 18, 2025, staff article: “Any vehicle with an electric motor in excess of 750 watts or that can travel over 20 miles per hour when powered only by the motor is not an electric bicycle, even if it has pedals and the manufacturer claims it is ‘street legal.’”
One 2025 product shows why “ships locked” needs scrutiny. Electrek reporter Micah Toll described the ONYX RCR 80V as having an 8-kilowatt nominal rear hub motor, a rating above 65 mph, and pedals that are unnecessary for propulsion. ONYX founder and chief design officer Tim Seward told Toll that the machine “comes locked at 20 mph and 750W when shipped.” California section 312.5(d)(1) still excludes a vehicle when its manufacturer intends it to be modifiable above 20 mph on motor power alone or above 750 watts.
Electrek called that ONYX an electric moped. California section 406(a) draws a narrower box: a moped has two or three wheels, fully operative pedals or electric-only power, an automatic transmission, less than 4 gross brake horsepower, and a maximum of 30 mph on level ground. At its advertised unlocked speed, the 65-mph ONYX exceeds that state-law speed ceiling. The seller's category name cannot establish its California registration class.

A throttle-driven product advertised at 40, 50, or 70 mph exceeds the 30-mph moped ceiling as well as the electric-bicycle thresholds. Its status then depends on the motor-vehicle definitions and whether it can be registered, a question the e-bike label cannot answer.
Where may a California Class 3 e-bike be ridden?
The 28-mph classification does not decide access. California's Vehicle Code sets statewide rules, while local authorities and public agencies retain power over specified trails. The federal 750-watt consumer-product definition supplies no trail permission.
Current section 21207.5 imposes no blanket statewide Class 3 ban on bicycle paths. It allows the authority responsible for an equestrian, hiking, or recreational trail to prohibit electric bicycles or any class by ordinance. The Department of Parks and Recreation may prohibit any class on a path or trail in its jurisdiction. Check the ordinance or posted rule for the actual route rather than carrying a permission from one city into the next.
Section 21212 requires a bicycle helmet for riders under 18 on a street, bikeway, or other public bicycle path or trail. Section 21213 goes further for Class 3: the operator must be at least 16, and every operator and passenger on those public routes must wear a properly fitted and fastened ASTM- or CPSC-standard bicycle helmet. The rule also covers a passenger in an attached restraining seat or trailer.
How far does a Class 3 e-bike take to stop?
No universal distance can be calculated from the Class 3 label. An actual stopping distance at 28 mph needs a controlled brake test that identifies the bicycle, rider load, tires and pressure, pavement, grade, wind, and weather. Section 312.5 measures assistance cutoff; it contains no stopping-distance test.
The federal bicycle rule provides a narrower benchmark. Under 16 CFR 1512.5 and 1512.18, a handbrake-only bicycle with an equivalent ground speed above 15 mph must stop within 4.57 meters (15 feet) from an actual test speed of at least 15 mph. The performance test uses a rider of at least 150 pounds, four runs, a dry and smooth paved course with a slope below 1 percent, and wind below 7 mph.
That 15-foot requirement is not a reported stopping distance from 28 mph. Before buying a Class 3 model, ask for a model-specific brake result from the claimed assisted speed and read the test conditions. A page that repeats the federal 15-foot figure without its 15-mph test speed has left out the figure that matters.
California section 24016(a)(2) separately requires the motor to disengage when the brakes are applied, or to use a control that causes disengagement when released or activated. That electrical cutoff says nothing about tire grip on wet paint, loose gravel, or a loaded cargo bike.
How can a buyer verify an e-bike speed claim?
- Find the permanently affixed label. Read its class, top assisted speed, and motor wattage, printed in at least 9-point Arial, and compare all three with the listing.
- Identify the mode behind the largest speed. The seller should distinguish pedal assistance, throttle propulsion, 3.7-mph walk or start assistance, downhill coasting, and an unlocked controller.
- Test the figures against section 312.5: 20 mph for Class 1 and Class 2, 28 mph plus a speedometer for Class 3, and a motor that does not exceed 750 watts.
- Look for unlocking instructions. Manufacturer intent to make the vehicle exceed 20 mph on motor power alone or 750 watts triggers section 312.5(d), even while the shipping setting displays legal numbers. Section 24016(e) also bars sales of devices or applications that push an e-bike beyond the definition.
- Check the actual route. Apply section 21207.5, the local ordinance or State Parks posting, section 21213 for Class 3 riders, and section 21212 for anyone under 18.
If the seller cannot identify the assistance mode or reconcile the advertisement with the frame label, the speed claim is incomplete. A buyer still lacks the information needed to classify the vehicle.

Can e-bikes go 50 mph?
A California electric bicycle under Vehicle Code section 312.5 cannot assist at 50 mph. Class 3 pedal assistance ceases at 28 mph. A throttle-driven product advertising 50 mph needs a valid motor-vehicle classification; pedals and an “e-bike” name do not provide one.
Can e-bikes go 40 mph?
